The Bundestag, Bundesrat, or Federal Government can initiate proceedings to ban a party before the Federal Constitutional Court. SPD, Greens, and Left Party are in favor of banning the AfD. Since they form or participate in the government in many federal states, it is important to take advantage of these majority ratios. The AfD does not yet have any seats in the Bundesrat. What is the Bundesrat?
The Bundesrat is the representative body of the federal states. Through it, they participate in the legislative process. As one of the five permanent constitutional bodies of the Federal Republic, the Bundesrat must represent the interests of the federal states, but also take into account those of the state as a whole.
The Bundesrat has 69 seats, which are distributed among the individual governing parties of the federal states in varying numbers. Each federal state has at least three votes.
How does the Bundesrat vote?
In the **Bundestag, all members of parliament decide for themselves how they stand on an issue. In the Bundesrat, members of parliament must vote according to the will of their parliamentary group.
The governing parties of the individual federal states must agree.
If they cannot agree on approval, the federal state with all its seats in the Bundesrat is considered to have rejected the bill. Abstentions count as no votes. 35 votes, i.e. an absolute majority, are required for a bill to be passed.
