Panel discussion on the urgency of this demand

The Basic Law contains provisions to protect the constitutional order from attacks by enemies of humanity and democracy. The “Alternative for Germany” (AfD) is a party of enemies of the free and democratic basic order in the country. This no longer requires any certification from official bodies - the evidence collected outside parliament and outside the authorities is overwhelming.

We can currently observe the dangerous consequences of the influence or even government participation of this party in real time in the USA. Under Donald Trump's second presidency, the right-wing authoritarian and Christian fundamentalist restructuring and dismantling of the democratic constitutional state has become almost irreversible after just a few months in office.

For anyone who has followed these developments in recent years, it should be obvious that the AfD is precisely the case for which the Basic Law provides for the possibility of a party ban. However, the bodies that could initiate such proceedings before the Federal Constitutional Court - the Federal Government, Bundestag and Bundesrat - are hesitating, and the same bogus arguments are always put forward for this inaction.

That is why we have invited three experts on this topic who can give us and you an insight into the legal, political and social issues associated with a party ban procedure against the AfD. Why are the decision-makers hesitating? What are the similarities and differences to the failed NPD ban proceedings? How much and what evidence is needed for a successful ban procedure? What would be the consequences of a ban? What happens if the ban procedure fails?

Prof. Dr. Kathrin Groh is Professor of Public Law at the University of the Federal Armed Forces in Munich. She co-signed the legal opinion on a ban procedure against the AfD.

Cornelia Kerth is the federal chairwoman and spokeswoman of the Association of Persecutees of the Nazi Regime - League of Anti-Fascists (VVN-BdA). In 2009, she represented a petition supported by 175,500 citizens and submitted to the Bundestag for the NPD to be banned. In 2023, she initiated a debate on a campaign to ban the AfD.

Cemal Bozoğlu is the spokesperson for strategies against right-wing extremism for the Green parliamentary group. He has followed the continuous radicalization of the AfD since its entry into the Bavarian state parliament in 2018 and sees it as the greatest threat to our democracy.
